KRALJEVSKI VINOGRADI d.o.o. operates in accordance with the laws of the Republic of Croatia.

1. GENERAL PROVISIONS

1.1 These General Terms and Conditions for the use of the website and the use of the Webshop service ("General Terms") regulate the use of the websites by users and the use of the Webshop service.

1.2 In these General Terms, terms written in bold have the following meaning:
KRALJEVSKI VINOGRADI means KRALJEVSKI VINOGRADI d.o.o., with its registered office in Zadar, Zrinsko-Frankopanska 38, VAT ID: 42358685803.

Website refers to all web, or Internet, pages owned by KRALJEVSKI VINOGRADI.

User means any natural person with permanent or temporary residence in the Republic of Croatia who accesses the websites. The term user also includes a registered user.

Registered user means any legally and fully capable person, legal or natural, who has registered to use the webshop service on the websites and has a permanent residence or registered office in the Republic of Croatia.

Webshop service is a service that allows registered users to purchase KRALJEVSKI VINOGRADI products via the websites.

1.3 By accessing the websites via an appropriate technical means of access and using them, every user undertakes to respect these General Terms and agrees that the provisions of these General Terms shall apply to them.

2. LIMITATIONS OF USE AND LIABILITY

2.1 The user undertakes not to:
- use the websites in any way that is contrary to positive regulations;
- upload to or distribute via the websites any content that is contrary to positive regulations, including but not limited to harmful, threatening, harassing, vulgar, pornographic content, content that spreads hatred and racial intolerance, content that infringes upon the rights and interests of others, and similar;
- alter, delete, or destroy any data on the websites;
- use the websites to violate the rights of third parties, including for the violation of secrets, intellectual property rights, or other rights or interests of third parties;
- use the websites to send emails contrary to these General Terms;
- upload or distribute via the websites any illegal software, including but not limited to viruses, spyware, Trojans, or similar.

2.2 The documents, data, and information published on the websites may not be reproduced, distributed, or used in any way for commercial purposes without the explicit consent of KRALJEVSKI VINOGRADI or in any way that may cause damage to KRALJEVSKI VINOGRADI or any third party. The documents, data, and information published on these websites may be used only for the individual needs of the user, while respecting all copyright and ownership rights and the rights of third parties.

2.3 By using the content of these websites, the user accepts (i) all risks arising from the use of the websites and agrees (ii) to use the content of the websites exclusively for personal use and at their own responsibility.

2.4 KRALJEVSKI VINOGRADI completely disclaims all liability (i) that may in any way arise from, or be in any way related to, the use of the websites, (ii) for any actions of the user through the use or misuse of the content of the websites, and for (iii) any damage that may be incurred by the user or any third party in connection with the use or misuse of the content of the websites.

2.5 The websites also contain documents, data, information, as well as links to other Internet pages created

by third parties which will, to the extent necessary and possible, be designated as such. KRALJEVSKI VINOGRADI has no control over the mentioned documents, data, information, or other Internet pages in general and completely disclaims any responsibility, including but not limited to the accuracy, completeness, and availability of the content on Internet pages created by third parties. KRALJEVSKI VINOGRADI disclaims any responsibility for any content displayed on such third-party pages, as well as for any products or services that may have been obtained through such third-party pages. It shall not be considered that such third parties are in any way connected with KRALJEVSKI VINOGRADI merely due to the existence of a link to the website.

2.6 KRALJEVSKI VINOGRADI reserves the right to change the content of the websites, the right to terminate the websites, and the right to restrict access to the websites, all without notice, and will not be liable for any possible consequences resulting from such changes, termination, or restrictions.

2.7 KRALJEVSKI VINOGRADI will not be liable for any possible consequences resulting from the unavailability of the websites due to any technical reasons.

2.8 KRALJEVSKI VINOGRADI reserves the right to change the prices of its products.

2.9 KRALJEVSKI VINOGRADI reserves the right to prevent access to the websites for IP addresses (i.e., users) from which actions contrary to these General Terms are performed, and will not bear any responsibility on that basis.

2.10 KRALJEVSKI VINOGRADI is in no way liable to users for the costs they incur using computer equipment and telecommunication systems to access the websites and the webshop service.

3. INTELLECTUAL PROPERTY

3.1 The user accepts that the entire content of the websites is the exclusive property of KRALJEVSKI VINOGRADI or its authorized representatives.

3.2 By using the websites, the user is granted a limited, non-exclusive, non-transferable, and revocable license to use the content of the websites by viewing them for personal purposes.

3.3 To avoid any doubt, KRALJEVSKI VINOGRADI explicitly reserves and does not transfer to the user any other rights in relation to the content of the websites, and prohibits the use of the content of the websites, except as defined by these General Terms and as may be permitted by instructions on the websites themselves.

3.4 The user has no right to download, duplicate, modify, edit, distribute, display, delete, send, sell, resell, adapt, alter the content, create derivative works, include on other Internet pages or media, or use in any way other than for personal purposes for domestic use.

3.5 If it is explicitly permitted on the websites, the user will have the right to download certain content. In such a case, the user undertakes to use such content exclusively for personal use and to fully respect the provisions of these General Terms in relation to such content.

3.6 By uploading data, including photographs, to the websites by the user, such data becomes the exclusive property of KRALJEVSKI VINOGRADI.

4. PERSONAL DATA PROTECTION

4.1 Before accessing certain content, users will be required to provide KRALJEVSKI VINOGRADI with personal data. In case of consent to provide personal data, it will be considered that the users have agreed to the terms of use of personal data provided for in these General Terms, based on which certain persons are given the right to collect, use, process, and transfer personal data necessary for the use of the websites.

4.2 By checking the appropriate box or clicking the "I accept the General Terms" button on the websites, it is considered that the user agrees to the collection, use, processing, and transfer of personal data necessary for the use of the websites, including but not limited to:
- consent that KRALJEVSKI VINOGRADI may, in accordance with the provisions of the Personal Data Protection Act, process the provided personal data for the needs of its own records and the provision of other services, the creation of a customer database, informing about new products and services, and improving services, and that KRALJEVSKI VINOGRADI may provide the mentioned data to third parties for the purpose of performing the service, protecting the interests of KRALJEVSKI VINOGRADI users, and preventing potential misuse;
- the need for better insight and understanding of the individual needs and requirements of users, as well as developing the possibility of providing all KRALJEVSKI VINOGRADI services in the best possible way to the satisfaction of the users;
- providing data to other persons necessary for the performance of the above-mentioned purposes.

4.3 KRALJEVSKI VINOGRADI will store personal data only for as long as necessary for the purposes provided for in these General Terms. After that time, personal data will be destroyed, deleted, or made anonymous in a way that ensures the security of the personal data is maintained.

4.4 KRALJEVSKI VINOGRADI will not disclose personal data to third parties, except to persons within its group of companies.

4.5 KRALJEVSKI VINOGRADI will ensure that personal data is kept in a secure place (which includes reasonable administrative, technical, and physical protection to prevent unauthorized use, access, disclosure, copying, or modification of personal data), which can only be accessed by authorized persons.

4.6 KRALJEVSKI VINOGRADI will allow users access to their personal data that it holds to ensure that the personal data is accurate, complete, and up-to-date.

4.7 If users have any questions regarding the use of personal data, they can contact KRALJEVSKI VINOGRADI directly.

4.8 If users request the deletion of their personal data, KRALJEVSKI VINOGRADI will remove such data, but by doing so, they agree that they will be denied access to certain content on the websites.

4.9 When providing personal data, the user guarantees that it is complete, true, accurate, and up-to-date.
PayPal is a very popular electronic payment service that allows for secure and simple online payments. In short, PayPal is the leading "internet bank." A PayPal account needs to be linked to a debit or credit card. A PayPal account is most often linked to a debit or credit card (Diners Club, Visa, MasterCard, American Express) and an email address. The Maestro card is not accepted by PayPal. These services are free for the buyer, and PayPal earns money by charging merchants a commission for each transaction. One of PayPal's biggest advantages is that when a user pays in a web store, they do not have to provide their credit card number or bank account information, which significantly reduces the risk of misuse of that information.

5. USE OF THE WEBSHOP SERVICE AND USER REGISTRATION

5.1 The use of the Webshop service is available exclusively to registered users who are of legal age and fully legally capable, which they confirm by using the Webshop service.

5.2 User registration is done via the websites, during which the user will be required to enter certain personal data and agree to the use of such personal data.

5.3 After successful registration, the registered user is given a username and password to use for the authorization of the Webshop service. The registered user is obligated to keep the username and password confidential. If the user suspects unauthorized use of their username and/or password, they are responsible for all possible costs caused by the use of their username and/or password until they inform KRALJEVSKI VINOGRADI via the contacts published on the website about the suspicion of unauthorized use. The user is also responsible for all unauthorized activities authorized and performed under their username and/or password.

5.4 By registering, the user confirms:
- that they fully accept these General Terms, especially the part that relates to the webshop services;
- the completeness, accuracy, truthfulness, and timeliness of personal data;
- that they give KRALJEVSKI VINOGRADI explicit consent to, in accordance with the provisions of the Personal Data Protection Act, process the provided personal data for the needs of its own records and the provision of other services, the creation of a customer database, informing about new products and services, and improving services, and that KRALJEVSKI VINOGRADI may provide the mentioned data to third parties for the purpose of performing the service, protecting the interests of KRALJEVSKI VINOGRADI users, and preventing potential misuse.

5.5 The registered user agrees that purchases via the Webshop service are made by the registered user purchasing products available via the Webshop service ("products") by selecting them based on the image and a basic description of the product. The images of the products are for illustrative purposes only and do not always and in all details have to correspond to the products that are actually available. Due to the possibility of individual monitor settings on the computer, differences in the perception of product color by the human eye, etc., KRALJEVSKI VINOGRADI does not guarantee a complete match of the product colors with the colors the registered user sees on their monitor screen.

5.6 Product ordering is done electronically. By clicking the "To cart" icon, the selected product is saved to the shopping cart. To continue the procedure, you need to click "CHECKOUT," where all the selected items are located. The goods are considered ordered at the moment the buyer completes the entire ordering process. A confirmation that the order has been received by KRALJEVSKI VINOGRADI d.o.o. will be sent to the email address you registered with as a buyer.

5.7 If KRALJEVSKI VINOGRADI is unable to deliver one of the ordered products, it will contact the buyer by phone or email and inform them of this. The buyer has the option to cancel the ordered product or request a replacement product.

6. PRICES OF PRODUCTS VIA THE WEBSHOP SERVICE

6.1 Product prices are expressed in Euros ("EUR") and include value-added tax. KRALJEVSKI VINOGRADI may determine certain discounts for purchases via the webshop that may apply for a certain period, but the mentioned discounts will not apply to clearly marked items and products in the "Promotional items" category.

6.2 Product prices are subject to change until the moment of purchase confirmation.

6.3 By confirming the purchase, registered users complete the purchase process via the webshop service. The purchase agreement is concluded at the moment of payment receipt.

6.4 The delivery price of the purchased products is not included in the product price.

7. DELIVERY VIA THE WEBSHOP SERVICE

7.1 Product delivery is possible within the territory of the Republic of Croatia, the EU, and all other countries.
Some products may not be able to be delivered to all countries, depending on the laws of those countries, of which the buyer will be informed when creating the order.

7.2 After KRALJEVSKI VINOGRADI registers the order (no later than 48 hours from the time the product is ordered by the registered user, which applies only if such a deadline expires during a working day in the Republic of Croatia and does not apply to non-working days), the products will be delivered to the registered user within the following time frames:
- 5 to 10 working days for the area of the City of Zagreb,
- 5 to 10 working days for the area of the continental part of the Republic of Croatia,
- 5 to 12 working days for the island areas.

7.3 If for any reason the User was not available via the contact number they left, KRALJEVSKI VINOGRADI is not responsible for the extension of the previously mentioned delivery times.

7.4 The order will be delivered to the User's delivery address, and if the User is not at the delivery address:
- a message with a number they can contact will be left for them, or
- the products can be picked up by another person (a legal-age member of the household, a person authorized by the registered user) upon presentation of a personal identification document.

7.5 The registered user is obligated to inspect the shipment upon receipt, report visible damages directly to the delivery person, and refuse to accept the damaged shipment. By signing the delivery note and receiving the invoice, the registered user confirms that they have inspected the product upon receipt.
If the registered user refuses to accept the shipment due to identified and visible damages on the transport packaging, they are required to fill out the appropriate form of the delivery service and notify KRALJEVSKI VINOGRADI by email or phone via the user instructions on the webshop pages and state whether they want a repeated delivery or a refund. Upon receipt of the claimed shipment and the appropriate form, KRALJEVSKI VINOGRADI undertakes to perform a repeated delivery within the next 15 working days if the product is in stock, and if the same product needs to be ordered from a supplier, the mentioned deadline is extended by the supplier's delivery time, without additional costs for the user or to issue a refund, all in accordance with the request of the registered user.

7.6 If the registered user does not accept the product or refuses to accept the product without a valid reason, KRALJEVSKI VINOGRADI reserves the right to demand compensation for the incurred costs.

8. RETURN OF PURCHASED PRODUCTS VIA THE WEBSHOP SERVICE

8.1 The registered user has the right, within eight (8) calendar days from the day of product delivery, to file a complaint about the purchased product or return the product if they notice defects in the products upon receipt or if the delivered products are faulty. KRALJEVSKI VINOGRADI will, based on the request for return or exchange, return the funds to the account that the user specified in the request itself or exchange the product with a new one within thirty (30) days from the date of receipt of the returned product at the address specified on the complaint form.

8.2 The registered user announces the return of purchased products via the complaint form after accessing the webshop service, using the username and password, by entering personal data and other data related to the purchase.

8.3 The return of delivered products is made by delivery to the address that the registered user is informed of on the complaint form.

8.4 The costs of returning the product are borne by the registered user.

8.5 The registered user is obligated to return the delivered products in the condition in which they were delivered to them and in the original packaging (the commercial packaging in which the goods were delivered).

8.6 If it is unequivocally determined that the complaint about the product is unfounded or that the ordered product's defect occurred due to inadequate handling or use, then KRALJEVSKI VINOGRADI is not obligated to issue a refund or deliver a replacement product. The complained product will be returned to the user at their expense with a written explanation of the reason for not accepting the request for a refund or exchange.

8.7 If the request for a refund or exchange is justified, KRALJEVSKI VINOGRADI will proceed as stated in section 9.1, with the cost of resending the product being borne by KRALJEVSKI VINOGRADI.

8.8 If there has been an error in the packaging of the ordered products and the buyer has not received the ordered product but another one, they are required to report this via the complaint form within eight (8) days. In this case, the user returns the incorrectly delivered product at the expense of KRALJEVSKI VINOGRADI, which undertakes to deliver the ordered product or issue a refund (in accordance with the user's request) within fifteen (15) days of receiving the incorrectly delivered item.

8.9 If the user has not received the ordered and paid-for product, they are required to report this within eight (8) calendar days from the expected arrival date of the ordered product via the complaint form or via the contacts published on the website. Within that period, KRALJEVSKI VINOGRADI is obliged to determine what happened with the claimed shipment and inform the user about the further resolution of the complaint.

9. OTHER TERMS OF THE WEBSHOP SERVICE

9.1 KRALJEVSKI VINOGRADI is not liable for any potential damage that may occur to the registered user and third parties:
- as a result of unauthorized use of the username and password or is related to such use,
- in connection with the use or misuse of the webshop service, if the damage in question did not occur due to the fault of KRALJEVSKI VINOGRADI.

9.2 KRALJEVSKI VINOGRADI is not liable for any damage that may occur due to an interruption of the internet connection while using the webshop service.

9.3 The provisions of the valid Electronic Commerce Act and other laws relating to the provision and use of the webshop service shall apply to the use of the webshop service.

10. AMENDMENTS TO THE GENERAL TERMS AND OTHER PROVISIONS

10.1 KRALJEVSKI VINOGRADI reserves the right to amend these General Terms without prior notice. Registered users are required to check the valid General Terms each time they use the websites, and especially the webshop service. The valid General Terms will be published on the websites.

10.2 For the use of the webshop service, the General Terms in effect at the time of receipt of the price for the ordered product are valid.

10.3 All disputes that may arise based on these General Terms will be resolved before the competent court in Zadar.

Documents published on this website may be copied only for non-commercial purposes and only for individual use, and with respect for all copyrights, other proprietary rights, and every mentioned restriction of rights.
